Costs

 

1. Contingency Fee

1.1 The Advocate will represent the client on a contingency or “no win - no fee” basis. This has one exception. There is a fee for attending disciplinary meetings (See 1.3 and 2.13). 1.2 This means:
i. Should The Advocate be unable to achieve a successful result, no fee shall be payable.
ii. Should The Advocate achieve a successful result without a payout, or with a payout of $1000 or less, a one-off fee of $200 + GST shall be charged and payable by the client.
iii. Should The Advocate achieve a result with a payment to you of $1001 or over, then fees will be charged as in section 2 below.

1.3 Exception. Should The Advocate running your case need to travel to a disciplinary hearing or a mediation, reasonable travel costs are to be negotiated and paid in full before travel. Often distance mediations can be conducted by phone at no disadvantage to the client. Preparation and attendance including by video link or phone to disciplinary meetings will be charged out at $80.00 plus gst per hour.

2. Success fees

2.1 For cases that are resolved up to and including mediation level The Advocate will charge a fee based on a percentage of the amount won. For amounts from $1001 - $10,000, a fee of 25% (plus GST) of the award over $1000 will be payable.

Should the amount exceed $10,001, 10% of the amount between $10,001 and $50,000 will be added to the initial fee above. Any portion of a settlement of $50 0001 and above attract no additional fees.

2.2 The only additional fees that will apply, payable by the client is if an employer refused to attend mediation. In that case a filing would need to be made at the Employment Relations Authority (ERA) costing $71.56 (incl GST).

The ERA will then direct the employer to attend mediation.
